Industrial Commission Policies
Docketing Policy
The Industrial Commission recently utilized a Kaizen process to solicit input from customers on how the Commission’s docketing process could be improved to be more efficient. The docketing policy provided herein is a result of the suggestions received from that Kaizen group, and provides guidance for authorized representatives that request that hearings not be scheduled (“blocked out”) for specific dates.
Commission Resolution R10-1-01 permits authorized representatives of parties to request that the Commission not schedule hearings for particular dates, or a series of dates, as long as the Commission receives notice at least 15 state business days prior to the requested “block out date(s)” pursuant to the following limitations:
A) Hearing blocks for full day statewide block-
- Requests for full day hearing blocks will be honored for no more than twenty-two days per calendar year.
B) Hearing blocks for full day that are requested for less than a statewide block-
- Requests for full day hearing blocks in less than six Commission district offices will be honored for no more than ten days per calendar year.
- Requests for full day hearing blocks in six or more Commission district offices will be the equivalent of one full day statewide block.
C) Hearing blocks that are requested for half of a hearing day (i.e., the morning or the afternoon of a hearing day)-
- Requests for blocks for half a day will be honored for no more than 20 half days per calendar year.
D) The maximum number of full hearing day blocks that the Commission will honor will not exceed a total of 42 full day hearing blocks per year under the limitations set forth in paragraphs (A) through (C).
E) The Industrial Commission’s docketing system will only honor a hearing block if a representative has been designated as the docketing representative on a claim.
F) Under the instant policy, if a timely request for hearing block is received by the Commission, the Commission will not schedule claims for hearing during the block out period when the requesting representative is designated as the docketing representative in the claim.
G) Representatives are encouraged to manage requests for block outs though ICON. Representatives calendars on ICON will set forth the block out dates that are timely requested by the representative as described in paragraphs (A) through (C).
